1. Scope and acceptance
These Terms of Service ("Terms") apply to any individual or entity that visits, views, accesses, or uses the KTM Apartments website at ktmapartments.com and related services (the "Platform", "we", "us").
By accessing or using the Platform you agree to these Terms. If you do not agree, do not use the Platform.
These Terms work together with our Privacy Policy, Website Terms & Conditions, and the other documents listed on our Legal page. If a more specific document applies to your activity (for example posting a listing or buying advertising), that document also binds you.
2. Definitions
"Platform" — the KTM Apartments website, apps, APIs, and related services.
"User", "you" — any person or entity that visits or uses the Platform.
"Member" — a registered account holder.
"Listing" — a property advertisement published on the Platform.
"Content" — text, images, video, data, or other material you submit or that appears on the Platform.
3. Eligibility and accounts
Eligibility. You must be at least 18 years old and have legal capacity to contract under the laws of Nepal or your applicable jurisdiction.
Accounts. Provide accurate registration information. Keep credentials confidential and notify us at hello@ktmapartments.com of suspected unauthorised access. One account per person or entity; creating accounts to evade limits or moderation is prohibited.
Business users. If you act for an organisation, you represent that you have authority to bind it to these Terms.
4. Acceptable use
You may use the Platform only for lawful purposes related to discovering, listing, or advertising residential and related property in Nepal (and other markets we may support).
You must not:
Scrape, harvest, or bulk-download Platform data except through documented public interfaces we expressly allow;
Interfere with security, availability, or integrity of the Platform;
Impersonate others or misrepresent affiliation with KTM Apartments;
Circumvent access controls, quotas, or payment requirements;
Use the Platform to harass, defraud, or unlawfully discriminate against others.
You represent that content you submit is accurate, lawful, and that you have the rights needed to publish it. We may refuse, edit, suspend, or remove content that violates these Terms or applicable law, without obligation to monitor all content in advance.
6. Marketplace role
KTM Apartments is a technology platform that connects seekers, owners, and advertisers. Unless we expressly state otherwise in writing:
We are not a party to rental, sale, or agency contracts between users;
We do not verify legal title, zoning, or habitability;
Users are solely responsible for their own due diligence and for complying with Nepal law (including tax and registration obligations).
Nothing on the Platform is legal, financial, or real-estate advice.
The Platform’s branding, software, design, and original editorial content belong to KTM Apartments or its licensors. You may not copy or exploit them except as needed to use the Platform as intended.
You retain ownership of content you submit, and grant us a worldwide, non-exclusive, royalty-free licence to host, display, distribute, and adapt that content for operating, promoting, and improving the Platform.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free service, or that listings are complete or accurate.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KTM APARTMENTS AND ITS OFFICERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.
OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE PLATFORM IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THAT PERIOD, OR (B) Rs 10,000.
These limits do not exclude liability that cannot be limited under Nepal law.
12. Indemnity
You agree to defend, indemnify, and hold harmless KTM Apartments from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Platform, or your breach of these Terms or applicable law.
13. Suspension and termination
We may suspend or terminate access, listings, or accounts for breach of these Terms, legal risk, non-payment, or prolonged inactivity. You may stop using the Platform at any time. Provisions that by nature should survive (including IP, disclaimers, liability limits, and indemnity) survive termination.
14. Changes
We may update these Terms by posting a revised version on the Platform. Material changes take effect when posted or on a later date we state. Continued use after the effective date constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of Nepal. Courts in Kathmandu, Nepal have exclusive jurisdiction, without prejudice to mandatory consumer protections that cannot be waived.
