1. Purpose
These Website Terms & Conditions ("Website Terms") apply to any individual or entity that uses KTM Apartments ("the Platform", "we", "us") for services relating to the site’s application features, screening and communication tools, leasing-related workflows, and payment processing functionality.
By using these site services you agree to these Website Terms.
2. Site services covered
Without limitation, these Website Terms cover:
Account registration, login, and profile management;
Search, map, compare, favourites, and listing detail tools;
Enquiry, messaging, and visit-request flows between seekers and listers;
Owner/agent dashboards for listings, leads, and performance;
Verification flows (for example email OTP, phone, or WhatsApp where offered);
Subscription, boost, and other payment-processing entry points;
Reporting, appeals, and support request forms.
3. Acceptable use of application features
You agree to use the Platform only for lawful residential and commercial property discovery and advertising purposes. You must not:
Probe, scrape, or overload the Platform beyond ordinary interactive use;
Bypass authentication, rate limits, or entitlement checks;
Upload malware or attempt unauthorised access to accounts or data;
Misuse messaging to harass, spam, or phish other users;
Reverse engineer non-public parts of the service except where mandatory law allows.
4. Screening and communications
Tools that help owners screen or communicate with seekers (enquiries, visit scheduling, contact reveal after inquiry, verification badges) are facilitation features only. We do not:
Guarantee the identity, creditworthiness, or suitability of any user;
Conduct full background or police checks unless a separate product expressly says so;
Supervise in-person visits or handovers.
Users remain responsible for their own screening decisions and for complying with Nepal tenancy and consumer laws.
5. Leasing-related functionality
Where the Platform helps document interest in a rental (for example visit requests or inquiry threads), those records are operational aids. They do not automatically create a lease. Any lease, rent agreement, deposit, or sale deed is formed between the parties under applicable law and separate documentation.
6. Payment processing functionality
Checkout pages, plan selection, and payment status screens are part of the site’s payment processing functionality. Successful payment is determined by gateway confirmation and our settlement records. See the E-commerce Internet Advertising Terms for charges, refunds, and invoices.
7. Availability and changes
We aim for reliable uptime but do not warrant uninterrupted or error-free operation. Features may be added, modified, or retired. Material removals of paid functionality will be handled under the E-commerce Terms where applicable.
8. Privacy and cookies
Use of site services involves processing personal data as described in our Privacy Policy and Cookie Policy.
9. Termination of access
We may suspend or terminate access to site services for breach of these Website Terms, fraud, abuse, or legal risk. You may stop using the services at any time; some data retention obligations may continue as described in the Privacy Policy.
10. Governing law
These Website Terms are governed by the laws of Nepal, without regard to conflict-of-law rules, unless mandatory consumer protections in your place of residence provide otherwise.
